What ESHB1817 and RCW 49.80 Require
ESHB1817, enacted in 2019, places stringent requirements on owners of petroleum refining or petrochemical manufacturing facilities when contracting for construction, alteration, demolition, installation, repair, or maintenance work. This law falls under Chapter 49.80, RCW, and mandates:
1. Skilled and Trained Workforce: Owners and operators of high-hazardous facilities must ensure that their contractors and subcontractors employ a skilled and trained workforce to perform onsite work within apprenticeable occupations in the building and construction trades.
2. Definition of a Skilled and Trained Workforce: A skilled and trained workforce comprises workers who are either registered apprentices or skilled journeypersons. A registered apprentice is actively participating in a Washington State Apprenticeship and Training Council (WSATC)-approved apprenticeship program. A skilled journeyperson is someone who has graduated from a WSATC-approved apprenticeship program for the applicable occupation or has accumulated sufficient on-the-job experience, is paid at a commensurate rate, and meets specific wage criteria.
3. Advanced Safety Training: Skilled and trained workers must complete 20 hours of advanced safety training every three years.
